Retaliation is defined as an adverse action taken against an individual who, reasonably and in good faith, files a discrimination or harassment complaint (formal or informal), participates in the investigation or resolution of a discrimination or harassment complaint or otherwise demonstrates opposition to a discriminatory practice or policy.
In addition to the protections against retaliation that are included in state and federal laws enforced by the Equal Employment Opportunity Commission (EEOC), the Americans with Disabilities Act (ADA) also protects individuals from coercion, intimidation, threat, harassment, or interference in their exercise of rights granted by the ADA. Retaliation is also prohibited under University policy.
If retaliation occurs, it is considered a separate offense from the original complaint, regardless of the outcome of the original complaint. Anyone who believes they have experienced retaliation should promptly contact the Diversity and Inclusion Office.
