Leave of Absence

A leave of absence (LOA) is a paid or unpaid approved absence* from work for a specific period of time. If you are going to be out of work for more than five consecutive days, you must contact the Leave Administrator at 508-856-2131 to request the necessary paperwork.

*Approved Leave of Absence: If FMLA, job protection is afforded to the employee. 

Types of Leaves

 

Adoption: This leave is granted for placement of a child in the employee's care for adoption.

Maternity Leave: This is granted to female employees for the birth of the employee's child. (This applies when there are no medical complications due to pregnancy or childbirth; if there are medical complications due to pregnancy, a Medical Leave of Absence will apply.)

Paternity Leave: This is granted to employees whose spouse/partner gives birth to a child.

Medical Leave: This is granted to employees that have to be out of work due to a personal illness.

Family Illness: This is granted to employees that have to be out of work to care for a family member who has a serious health condition (as defined by the FMLA). For purposes of this policy, a family member is defined as an employee's spouse, children and parents.

Workers’ Compensation: This is granted to employees that are absent from work due to an injury at work or an illness as a result of performing work duties.

Personal: Employees can apply for a personal leave for reasons that may not meet the definitions of the other types of Leave of Absence. A Personal Leave must be approved by the employee’s department and by Human Resources.

Military Leave: Employees who are called to active duty or training are granted a military leave of absence. For guidelines review the policy on Military Leave.

Small Necessities Leave: This is granted to employees who need to take time off to participate in their children’s school activities, medical or dental appointments; or to accompany an elderly relative to routine medical or dental appointments. Miscellaneous Paid Leave of Absence: This is granted to employees for different reasons such as to attend industrial accident hearings, donate blood, etc. For more information please read the policy Miscellaneous Paid Leave of Absence.

FMLA

UMMS complies with all requirements of the Family and Medical Leave Act of 1993 (FMLA). The FMLA provides up to 12 weeks of job protected paid or unpaid leave for eligible employees to care for an employee's child after birth or placement for adoption or foster care, to care for the employee's spouse, children or parent who has a serious health condition, or for a serious health condition that makes the employee unable to perform his or her job. If you need to take a leave of absence for your own illness, you must complete the Leave of Absence Request Form and have it signed by your supervisor. Your physician must complete the medical certification form. Please contact the Leave Administrator at 508-856-4194 if you need to request a leave. 

Paid Leave of Absence

To be paid while you are on a leave of absence you will need to use your accruals (personal, vacation and sick time if appropriate). Use of sick time will be required for all medical leaves. However, if an employee is on maternity leave she may elect not to use sick time for the first eight weeks after giving birth.

The primary caretaker may use up to eight (8) weeks of sick time for the adoption of a child. A non-primary caretaker may use up to 3 weeks of sick time for the adoption of a child. Please read the Sick Time Policy for additional information.

Your health, dental insurance and other benefits will continue if you are on a paid leave of absence.

Unpaid Leave of Absence

If you are on an unpaid leave of absence for medical reasons or for maternity you may apply to continue paying for your basic life and health insurance premiums at the employee contribution rate (the contribution percentage you were paying while you were receiving a paycheck).

You must complete and submit the Application to Continue Part Cost Premiums - Form 11 to the UMMS HR Service Center. You, your physician and the UMMS HR Service Center must complete the Form 11 before it will be considered by the Group Insurance Commission (GIC). If you are on a leave of absence because of a personal illness you must exhaust your vacation, personal and sick time before you apply for the employee contribution rate.

The GIC will notify you of its decision. If you do not pay your premium or UMMS no longer continues your employment, your benefit coverage will end.

If you are on an unpaid leave of absence for any reason other than your own personal illness, you will be billed 100% of the health insurance premium directly by the GIC (Group Insurance Commission). In this case you will not have the option of applying to pay the employee contribution rate. Failure to pay these bills will result in termination of health insurance due to non-payment and you will not be able to re-enroll until the next open enrollment period.

Military Leave

UMMS employees who are called for active duty or military training are placed on a military leave of absence consistent with state and federal guidelines. For information please read the Military Leave of Absence Policy.

Employees with Health insurance coverage taking military leave of absence have the following options:

  • Employees with family coverage may want to consider benefits offered to military members by the Federal Government or they may continue GIC coverage. The GIC will directly bill employees at the employee contribution rate at their home address. As long as the monthly premiums are paid, the employees' families may continue group benefits.

  • Cancel all insurance coverage and be reinstated upon return from military leave. The employee will be reinstated with the same GIC coverage s/he carried immediately prior to the unpaid military leave of absence.

  • Cancel health coverage and retain life insurance only coverage. The employee will be directly billed at the employee contribution percentage for the life insurance coverage.

To cancel or change your health insurance coverage, please complete the GIC Insurance Enrollment and Change Form (Form 1) and the Insurance Data Form (IDF).
